Membership Agreement:
Welcome to
iKnowthat.com.
Before
becoming a member of this site, before using or registering as a member of,
or allowing your child (and/or any other person) to use, the iKnowthat.com
web site located at www.iKnowthat.com
and/or the iKnowthat.com service is provided to you, the
"Service", please carefully read the following member agreement
("Agreement" or “Terms”). Your ("You") use of this
site means you agree to these Terms.
iKnowthat.com
(herein referred to as "we," "us," or "our")
reserves the right to change or modify these Terms at any time. Please check
these terms periodically for changes.
In
this Agreement, "System Administrator" means the person who
initially registers for the Service and establishes the subscribed
account ("Parent Account") with iKnowthat.com (or in the case of
the free and/or public areas of the Service, "System
Administrator" or "Member" refers to any user using any
element or portion of the Service). The System Administrator must be 18
years or older to establish the Subscribed Account.
Your ongoing use of the site acts as a continued agreement to any changes in these Terms. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you may cease to use your Account and, in the case of the System Administrator, terminate your Account. The continued use of the Service by you will mean you accept any and all such changes.
Usage
Family
memberships:
A
Family will consist of one system administrator and five
sub-accounts (each sub-account being also referred to herein individually as
a "Child Account" collectively as the "Family Members") for the System Administrator's
children, persons for whom the System Administrator is the legal guardian
(the Parent Account and any Child Account sub-account are collectively
referred to in this Agreement as the "Account"), or another adult
living in the home. All Family
Members may have unlimited access to their account.
Any Family Member may create, save and show projects. Additional sub-accounts may be added; contact subscriptions@iknowthat.com.
Classroom
Memberships:
A Classroom will consist of one System Administrator, with the ability to add 33 Child Accounts. To add additional children, please contact subscriptions@iknowthat.com Classroom members will have unlimited access to their accounts, allowing members to create, save and show projects.
School
and district level subscriptions packages are also available. Contact subscriptions@iknowthat.com
for more information.
Standards
of Conduct
Any
users or members of this site shall not create or store projects that
contain material that is:
libelous
defamatory
obscene
pornographic
threatening
illegal
abusive
copyright infringement
an invasion of another person's privacy
Although
we do not screen all user-created projects, they may be removed at the
discretion of iKnowthat.com Inc.
iKnowthat.com does not claim ownership of any content in these user created projects. However, iKnowthat.com may run advertisements on these project pages.
Use
of Your Account
As
the System Administrator for an Account, you are entirely liable for all
activities conducted through that Account, and are responsible for ensuring
that any other person who uses the Account complies with this Agreement.
Each person who uses the Account agrees to be bound by the terms of
this Agreement, whether or not such person is a Member. You will notify us
at subscriptions@iKnowthat.com
of any known or suspected unauthorized use(s) of your Account, or any known
or suspected breach of security, including loss, theft, or unauthorized
disclosure of your User Name and password. We will have no liability for any
circumstances arising from the unauthorized use of a User Name, Member's
password or your Account. Any fraudulent, abusive, or otherwise illegal
activity on your Account may be reported to appropriate law-enforcement
agencies by us. You are solely responsible for providing all computer
hardware, telephone and other equipment necessary to access the Service,
including without limitation Internet access software and modems.
If you have reason to believe that your Account is no longer secure (for example, in the event of a loss, theft, or unauthorized disclosure or use of your User Name, password, or any credit, debit, or charge card number stored on the Service), you must promptly change your password and notify us of the problem (by notice given as described in the Notice section below).
Submissions
At
iKnowthat.com Inc. we are always developing new activities as well as
improving the ones currently available. We gratefully accept comments and
feedback about the activities and material at the iKnowthat.com website.
However, to avoid any potential misunderstandings or conflicts, we ask that
you not submit any creative ideas, suggestions, or materials including
artwork, activity concepts, stories, or character ideas.
Disclaimer
of Warranty
Visitors
to iKnowthat.com expressly agree that use of the site is at the visitor's
sole risk. We do not warrant that access to the site will be uninterrupted
or error free; nor do we make any warranty as to the results that may be
obtained from the use of the site, or as to the accuracy, reliability or
content of any information, service, or merchandise contained in or provided
through the site.
THE
SITE IS FREE AND PROVIDED ON AN "AS IS," "AS AVAILABLE"
BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANT
ABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES
WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION
UNDER THE LAWS APPLICABLE TO THE TERMS OF USE. NO ORAL ADVICE OR WRITTEN
INFORMATION GIVEN BY IKNOWTHAT.COM SHALL CREATE A WARRANTY; NOR SHALL
VISITORS RELY ON ANY SUCH INFORMATION OR ADVICE.
Limitations
of Liability
Under
no circumstances, including negligence, shall iKnowthat.com Inc. be liable
for any direct, indirect, incidental, special or consequential damages that
result from the use of or inability to use the site; or that result from
mistakes, omissions, interruptions, deletion of files, errors, defects,
delays in operation, or transmission, or any failure of performance, whether
resulting from acts of

Fees
and Payment; Renewal; Cancellation
THE
TERMS OF THIS SECTION APPLY TO REGULAR IKNOWTHAT.COM SUBSCRIPTION ACCOUNTS
BILLED BY IKNOWTHAT.COM INC.
As
the System Administrator, you agree to pay all charges relating to your
Account, including applicable taxes, in accordance with billing terms set
forth below. When paying by credit card, you must provide us with valid credit
card information (Visa, MasterCard or American Express) throughout the time
that the Account is open.
Annual Family or Classroom Subscriptions:
For family and classroom subscriptions paid by credit card, we will charge the System Administrator's credit card
on the date the System
Administrator subscribes to the Service.
You
may notify us that you wish to cancel your subscription at any time by
sending an email to subscriptions@iknowthat.com.
We agree to terminate the Account upon receipt of notification from the
System Administrator. You will not be given any refund. You understand and
agree that cancellation of your account is your sole right and remedy with
respect to any dispute you may have with iKnowthat.com Inc.
Monthly Family Subscriptions:
For monthly family subscriptions, we will charge the System Administrator's credit card on the date the System Administrator subscribes to the Service. The credit card will continue to be automatically charged the monthly subscription rate each month on the same date as the initial subscription sign-up. Subscription sign-ups done on the 29th, 30th, or 31st of a month are charged on the 28th of subsequent months.
You may cancel your monthly subscription at any time via Member Options for your Account. Your subscription will be cancelled at the end of the currently active month.
These
terms are effective until terminated by either party. You may terminate
these terms at any time by notifying us of your desire to Cancel and
discontinuing use of the Service and destroying all materials obtained from
the Service and all related documentation and all copies and installations
thereof, whether made under the terms of this Agreement or otherwise. Your
access to the Service may be terminated immediately without notice from us
if in our sole discretion you fail to comply with any term or provision of
